End User License Agreement

1Agreement to Terms

This End User License Agreement ("Agreement" or "EULA") is a legal agreement between you ("User," "you," or "your") and Disabled Adventures LLC, a Missouri limited liability company ("Company," "we," "us," or "our"), governing your use of the QuoteGuard mobile application ("App") available on the Apple App Store.

By downloading, installing, or using QuoteGuard, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree to these terms, do not download, install, or use the App.

You must be at least 13 years of age to use QuoteGuard. By using the App, you represent that you meet this requirement. Users under 18 must have parental consent.

2License Grant

Subject to your compliance with this Agreement, Disabled Adventures LLC grants you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install one copy of the App on any Apple device that you own or control
• Use the App solely for your personal, non-commercial purposes
• Access and use the features of the App in accordance with this Agreement

This license does not include the right to sublicense, distribute, resell, or make the App available to any third party. All rights not expressly granted to you are reserved by Disabled Adventures LLC.

Intellectual Property

The App, including all content, features, AI models, design elements, trademarks, logos, and underlying technology, is owned by Disabled Adventures LLC and is protected by U.S. and international copyright, trademark, and other intellectual property laws. "QuoteGuard" and the QuoteGuard shield logo are trademarks of Disabled Adventures LLC.

3Restrictions on Use

You agree that you will not:

• Copy, modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the App
• Rent, lease, loan, sell, sublicense, distribute, or otherwise transfer the App or your rights under this Agreement to any third party
• Use the App for any unlawful, fraudulent, or commercial purpose without express written permission
• Remove, alter, or obscure any copyright, trademark, or proprietary rights notices from the App
• Use the App to transmit any viruses, malware, or other harmful code
• Attempt to gain unauthorized access to any portion of the App, its servers, or related systems
• Use automated tools, scripts, bots, or scraping tools to access or use the App
• Impersonate any person or entity or falsely represent your affiliation with any person or entity
• Use the App in any manner that could damage, disable, overburden, or impair the App or our servers
• Share your account credentials with others or allow multiple users to access the App through a single account

Violation of these restrictions may result in immediate termination of your license and legal action.

4Subscription & Billing

Free Tier

QuoteGuard offers a free tier that includes 1 contractor bid analysis and access to limited app features. No payment information is required for the free tier.

QuoteGuard Pro

QuoteGuard Pro is an optional paid subscription that unlocks unlimited analyses and all premium features. Pro is offered at the following rates:

• Monthly: $4.99/month
• Annual: $29.99/year (equivalent to $2.50/month)

New subscribers receive a 7-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically begin and your payment method will be charged.

Billing & Auto-Renewal

Payment is processed by Apple and charged to your Apple ID account. Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. Your account will be charged within 24 hours prior to the end of each current period.

Cancellation

You may cancel your subscription at any time through your Apple ID settings: Settings → [Your Name] → Subscriptions → QuoteGuard. Cancellation takes effect at the end of the current billing period. You will retain Pro access until that date.

Refunds

All purchases are processed by Apple. We do not process refunds directly. Refund requests must be submitted to Apple at reportaproblem.apple.com. Refunds are subject to Apple's refund policy.

Price Changes

We reserve the right to change subscription prices with reasonable notice. Price changes will be communicated in the App and will take effect at your next renewal date.

5AI Disclaimer & No Professional Advice

The AI analysis provided by QuoteGuard is generated by large language model technology and is based on general industry data, regional pricing averages, and pattern recognition. You expressly acknowledge and agree that:

• Bid analysis results are estimates only and may not reflect actual prices in your specific location, market conditions, or time period
• Pricing varies significantly based on materials, labor market conditions, contractor experience, project complexity, and local regulations
• QuoteGuard is not a substitute for obtaining multiple contractor bids, consulting licensed professionals, or seeking qualified legal or financial advice
• The AI may make errors, omissions, or produce inaccurate results
• We do not warrant the accuracy, completeness, or fitness for any particular purpose of any analysis results
• You assume full responsibility for any decisions you make based on QuoteGuard's output
• Contract review features do not constitute legal advice and are not a substitute for consulting a licensed attorney

Always obtain at least three independent contractor bids and verify licensing and insurance before hiring any contractor. QuoteGuard is a decision-support tool, not a definitive source of truth.

6Privacy Policy

This Privacy Policy explains how Disabled Adventures LLC collects, uses, and protects your information when you use QuoteGuard.

Information We Collect

• Account Information: Email address and name when you create an account
• Bid Images: Photos or documents you upload for analysis. These are transmitted to our AI provider for processing and are not stored beyond the duration of the analysis request
• Usage Data: App usage patterns, feature interactions, and crash reports to improve the App (collected anonymously)
• Device Information: Device type, iOS version, and push notification token (if you grant permission)
• Location: City/region only, if you choose to provide it for more accurate regional pricing benchmarks. We do not track precise GPS location

How We Use Your Information

• To provide and improve the QuoteGuard service
• To process bid analyses via our AI provider (Anthropic, Inc.)
• To send push notifications if you opt in (e.g., warranty reminders, weekly tips)
• To provide customer support
• To comply with legal obligations

Data Storage & Security

Analysis results and app data are stored locally on your device using encrypted storage. Account authentication is managed by Supabase with industry-standard security practices. We do not sell your personal information to third parties.

Third-Party Services

• Anthropic, Inc. — AI analysis provider. Bid images are processed per Anthropic's privacy policy
• Supabase — Authentication and user data storage
• RevenueCat — Subscription management
• Apple — App distribution, payments, and push notifications

Data Retention & Deletion

You may request deletion of your account and all associated data at any time by emailing disabledadventures13@gmail.com with subject "Account Deletion Request." We will process your request within 7 business days.

Children's Privacy

QuoteGuard is not directed at children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, contact us immediately.

Changes to Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of significant changes through the App or via email. Continued use of the App after changes constitutes acceptance of the updated policy.

7Terms of Service

Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use of your account.

Acceptable Use

You agree to use QuoteGuard only for lawful purposes and in a manner consistent with this Agreement. You agree not to use the App to submit false, misleading, or fraudulent information.

User Content

By uploading bid documents or other content to the App, you grant Disabled Adventures LLC a limited, non-exclusive license to process that content solely for the purpose of providing the requested service. You represent that you have the right to upload any content you submit.

Service Availability

We do not guarantee uninterrupted or error-free access to the App. We reserve the right to modify, suspend, or discontinue the App or any feature at any time, with or without notice.

Termination

We reserve the right to suspend or terminate your account at any time, with or without cause, if we believe you have violated this Agreement. Upon termination, your license to use the App immediately ceases.

8Disclaimer of Warranties & Limitation of Liability

Disclaimer of Warranties

We make no representations or warranties that: (a) the App will meet your requirements; (b) the App will be uninterrupted, timely, secure, or error-free; (c) any results obtained from the use of the App will be accurate or reliable; or (d) any errors in the App will be corrected.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL DISABLED ADVENTURES LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY:

• Indirect, incidental, special, punitive, or consequential damages
• Loss of profits, revenue, data, or business opportunities
• Damages arising from your reliance on AI-generated analysis results
• Damages resulting from contractor disputes, overcharges, or project outcomes
• Damages exceeding the amount you paid for the App in the 12 months prior to the claim

Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability, so the above may not apply to you in full. In such cases, our liability is limited to the greatest extent permitted by applicable law.

Indemnification

You agree to indemnify, defend, and hold harmless Disabled Adventures LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the App, your violation of this Agreement, or your violation of any rights of another person or entity.

9Governing Law & Dispute Resolution

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Missouri, United States of America, without regard to its conflict of law principles.

Jurisdiction

Any legal action or proceeding arising under this Agreement shall be brought exclusively in the state or federal courts located in Missouri, and the parties hereby consent to personal jurisdiction and venue therein.

Informal Resolution

Before initiating any formal legal proceeding, you agree to contact us at disabledadventures13@gmail.com and attempt to resolve the dispute informally. We will make a good-faith effort to resolve most concerns within 30 days.

Class Action Waiver

TO THE EXTENT PERMITTED BY LAW, YOU WAIVE YOUR RIGHT TO PARTICIPATE IN ANY CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST DISABLED ADVENTURES LLC.

Severability

If any provision of this Agreement is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary so that this Agreement will otherwise remain in full force and effect.

10Apple App Store Requirements

You acknowledge and agree that:

• This Agreement is between you and Disabled Adventures LLC only, not with Apple, Inc. Apple is not responsible for the App or its content
• Apple has no obligation whatsoever to furnish any maintenance or support services for the App
• Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App
• In the event of any third-party claim that the App or your possession and use of the App infringes a third party's intellectual property rights, Apple will not be responsible for the investigation, defense, settlement, or discharge of such claim
• Apple and its subsidiaries are third-party beneficiaries of this Agreement, and upon your acceptance, Apple will have the right to enforce this Agreement against you as a third-party beneficiary
• You must comply with applicable third-party terms of agreement when using the App (e.g., you must not be in violation of your wireless data service agreement when using the App)
• The App is licensed to you on a limited, non-exclusive, non-transferable, non-sublicensable basis solely for your personal use on Apple-branded products running iOS that you own or control, as permitted by Apple's Usage Rules set forth in the App Store Terms of Service

The parties to this Agreement acknowledge that Apple has no obligation to provide any warranty with respect to the App. To the extent that the App fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price for the App (if any) to you; and, to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.

11Changes to This Agreement

We reserve the right to modify this Agreement at any time. We will provide notice of material changes by:

• Updating the "Effective Date" at the top of this page
• Displaying a notice in the App
• Sending an email notification (if you have provided your email)

Your continued use of QuoteGuard after any changes to this Agreement constitutes your acceptance of the new terms. If you do not agree to the modified Agreement, you must stop using the App and uninstall it from your device.

We encourage you to review this Agreement periodically to stay informed of any updates.
